Information Nation: Today, we have Byron Pederson, co-founder of Instant Tax Solutions with us to talk about the Tax Problem Resolution Services Coalition. Thank you for speaking to us today, Mr. Pederson.
Byron Pederson: Thank you for having me.
Information Nation: Many people don’t realize that tax problem resolution services like Instant Tax Solutions must be authorized to appear before the IRS. Are there regulations in place for these authorized representatives?
Byron Pederson: That’s part of what the Tax Problem Resolution Services Coalition hopes to make happen. While there are many resolution services out there, until recently there has been no regulation for the industry.
Information Nation: Does the Federal government now plan to regulate tax problem resolution services?
Byron Pederson: Last June, the Bureau of Consumer Financial Protection issued a notice that included regulation of debt relief services. One of those services was identified as services that provide medical or tax debt relief.
Information Nation: There is also pending telemarketing services legislation that will impact tax relief firms. Can you tell us about that bill?
Byron Pederson: The Telemarketing Sales Rule was passed in 2010, but the Federal Trade Commission ruled that it was unclear whether tax relief services are subject to this particular type of regulation. We are still keeping a close eye on the FTC’s regulation of the tax relief industry.
Information Nation: Tell us about the work the Tax Problem Resolution Services Coalition did with California Senate Bill 708…
Byron Pederson: The bill was intended to protect consumers against unsavory debt elimination companies. While the intended target was just, we could see that the bill was too broad and would have put all businesses that seek to help customers reduce debt in danger. Instant Tax Solutions and many others in the tax problem resolutions services field provide a valuable service in acting as a liaison between taxpayers and the IRS.
Information Nation: And the Coalition worked with the sponsoring Senator to achieve an exemption?
Byron Pederson: Yes, the Tax Problem Resolutions Services Coalition was able to obtain an exemption for any service that represents consumers in negotiating or settling tax debt with a taxing authority or entity. Without the hard work of the TPRSC, the bill might have had a very negative impact on our industry.
